DISTANCE SALES AGREEMENT

1. PARTIES

BUYER: The person who places an order electronically through the order form

2. SUBJECT OF THE AGREEMENT

This agreement regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation regarding the sale and delivery of the product(s) whose specifications and sales price are specified below, which the BUYER has ordered electronically from the SELLER's website etchandera.com.

3. PRODUCT(S) INFORMATION

The type, quantity, brand/model, sales price, payment method and basic specifications of the ordered product(s) are specified in the order form and order confirmation email.

4. GENERAL PROVISIONS

4.1. The BUYER declares that they have read and are informed about the basic specifications, sales price, payment method and preliminary information regarding delivery of the product subject to the contract on the etchandera.com website, and has given the necessary confirmation electronically.

4.2. The product subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, for each product, provided that it does not exceed the legal 30-day period.

4.3. If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible for the person/organization to be delivered not accepting the delivery.

5. PRICE AND PAYMENT

5.1. Product prices are the prices valid at the time of order.

5.2. Payment is made with the payment method selected during the order (credit card, debit card, etc.).

5.3. Prices include VAT. Shipping costs are specified separately.

6. DELIVERY

6.1. Products are sent by cargo to the address specified by the BUYER after order confirmation.

6.2. Delivery time is specified on the product page and in the order confirmation.

6.3. When receiving the product, it should be checked whether it is damaged or defective. Damaged/defective products should not be delivered to the cargo officer.

7. RIGHT OF WITHDRAWAL

7.1. The BUYER has the right of withdrawal within 14 (fourteen) days from the delivery of the product subject to the contract to themselves or the person/organization at the address they indicated.

7.2. To exercise the right of withdrawal, the SELLER must be notified by email (hello@etchandera.com) within this period and the product must be unused.

7.3. When the right of withdrawal is exercised:

  • The product must be in its original packaging, unused, with tags not removed
  • The original invoice must be returned
  • Return shipping costs are covered by the BUYER

7.4. Products for which the right of withdrawal cannot be exercised:

  • Products specially produced or personalized for the individual
  • Products that are not suitable for hygiene and health reasons (opened/used personal care products)
  • Discounted or promotional products (if specified)
  • Gift cards

8. RETURN AND EXCHANGE

8.1. For products accepted for return, the return request must be sent to hello@etchandera.com.

8.2. After return approval, the product should be sent according to the return instructions sent by the SELLER.

8.3. After the returned product reaches the SELLER, it is checked and if found suitable, the return process is completed within 10 business days.

8.4. The refund amount is refunded to the credit card or bank account used for payment.

9. SELLER'S OBLIGATIONS

9.1. The SELLER is obliged to deliver the product subject to the contract complete, in accordance with the specifications specified in the order, and with warranty documents if any.

9.2. If the product is damaged or its packaging is opened before delivery, the SELLER does not deliver the product to the BUYER and refunds the price.

10. BUYER'S OBLIGATIONS

10.1. The BUYER agrees to pay the price of the product ordered and the shipping fee, if any.

10.2. The BUYER is obliged to check whether the product is damaged/defective when receiving it.

11. RESOLUTION OF DISPUTES

In disputes arising from this agreement, the laws of the Republic of Turkey apply. Consumer Arbitration Committees and Consumer Courts in the BUYER's place of residence or where the goods/services were purchased are authorized to resolve disputes.

12. EFFECTIVENESS

When the BUYER confirms this agreement electronically, they are deemed to have accepted the provisions of the agreement. The agreement enters into force when the BUYER confirms the order.

Placing an order electronically by the BUYER means accepting all the terms of this agreement.
